Complain The first pleading on the part of the plaintiff in a civil action. Jurisdiction The legal authority of a court to hear a case or conduct other proceedings; power of the court over persons involved in a case and the subject matter of the case. Multiplicity of actions Numerous and unnecessary attempts to litigate the same issue. Witness One who testifies under oath to what he/she has seen, heard or otherwise observed. Parent Infant Trauma Syndrome (P.I.T.S.) See Battered Child Syndrome Decree A decision or order of the court. A final decree is one, which fully and finally disposes of the litigation. An interlocutory decree is a preliminary decree, which is not final. Appellee The party against whom an appeal is taken Restitution A party is said to "rest" or "rest his case" when he/she has presented all the evidence he/she intends to offer.
